Who We Are

The Phoenix's mission is to build a sober active community that fuels resilience and harnesses the transformational power of connection so that together we rise, recover, and live. The Phoenix recognizes that a user's choice to share information is a critical part of its ability to achieve its mission and drive impact. It has developed this policy to explain how and why it collects, uses, shares and otherwise processes personal information.
Whenever we change our policy, we will give reasonable notice by posting a notice on our home page or through a release on our mobile application. Since these policy change notices last only for a limited time, however, users should check this Privacy Policy regularly to see if there have been any changes.
Data We Collect
We collect information about users in a variety of ways depending on how they interact with us and our websites, mobile applications, products, and services, including:
- Directly from users when they provide it to us, such as when they register for an account, sign up to receive communications from us, place an order/make a purchase, or contact us by phone, email, or otherwise.
- Automatically through the use of cookies, server logs, and other similar technologies when users interact with our websites, mobile applications, advertisements, and emails.
- From other sources, including, for example, our affiliates, business partners, service providers, online social media networks, and other third parties, or from publicly available sources. For example, if someone submits a job application, or becomes an employee, we may conduct a background check.
Account Registration
We collect our user's name and contact information when they create an account. We also collect information relating to the actions that users perform while logged into their account. We have a legitimate interest in providing account related functionalities to our users. Accounts can be used for easy checkout and to save our users' preferences and transaction history.
Cookies and Tracking
We use cookies and clear GIFs. “Cookies” are small pieces of information that a website sends to a computer's hard drive while a website is viewed. We have a legitimate interest in making our website operate efficiently.
We may place tracking technology on our website that collects analytics, records how users interact with our website or allows us to participate in behavior-based advertising. This means that a third party uses technology (e.g., a cookie) to collect information about the use of our website so that they can report analytics to us or provide advertising about products and services tailored to our user's interests.
Demographic and Location Information
We collect personal information, such as age or location. When users engage with one of our Apps we may collect their location from the GPS, Wi-Fi, and/or cellular technology in the device to determine the location and distance related to our services. We have a legitimate interest in understanding our users and providing tailored services.
Member and Donor Information
We collect information from our members and donors including names, addresses, phone numbers, and email addresses. We use this information to update our membership and donor database.
Order Placement
We collect our users' name, billing address, shipping address, email address, phone number, and credit card number when they place an order. We use this information to perform our contract to provide products or services.
Surveys and Feedback
When users participate in a survey, we collect information that is provided through the survey. If our users provide us feedback or contact us for support, we will collect their name and email address, as well as any other content that sent to us, in order to reply.
Employment
If someone applies for a job posting, or becomes an employee, we collect information necessary to process their application or to retain them as an employee. This may include, among other things, their Social Security Number.
Sensitive Personal Information
We collect the following categories of sensitive personal information: a user's social security, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account, and a user's ethnic origin. This information is collected in order to process transactions, comply with laws, manage our business, or provide services. We do not “sell” or “share” sensitive personal information for purposes of cross-context behavioral advertising.
How We Use Information
We may use this information to:
- Respond to an email or other inquiry or request
- Help improve our services
- Customize our user's experience at our website and mobile application
- Send updates or notices about our organization and the products or services we offer that we think may be of interest to our users
- Identify our users when they visit our websites or use our mobile applications
- Conduct analytics
- Detect and protect against malicious, deceptive, fraudulent, or illegal activity, including violation of our policies and terms and conditions, security incidents, and harm to the rights, property or safety of our company and our users, employees or others
- Debug, identify and repair errors that impair existing intended functionality of our website and services
- Comply with our legal or regulatory obligations, to establish or exercise our rights, and to defend against a legal claim
- For internal administrative purposes, as well as to manage our relationships
- Facilitate registration for an event on the app hosted or co-hosted by a third party
- For such other purposes with consent (from time to time)
We may also combine this information with other generally or publicly available information to help us identify user's preferences or interests. We may provide information that identifies our users to companies that assist us in these activities, such as helping us fulfill our user's request for a product, participation at our events, donations, membership or information.
How We Share Information
In addition to the specific situations discussed elsewhere in this Privacy Policy, we may disclose personal information in the following situations:
- Affiliates and Acquisitions: We may share information with our corporate affiliates (e.g., parent company, sister companies, subsidiaries, joint ventures, or other companies under common control). If another company acquires, or plans to acquire, our company, business, or our assets, we will also share information with that company, including at the negotiation stage.
- Other Disclosures with Consent: We may ask if our users would like us to share their information with other unaffiliated third parties who are not described elsewhere in this policy.
- Other Disclosures without Consent: We may disclose information to third parties where we have a legitimate interest in providing our users with our products or services. This includes sharing information with our third party data cooperative. In addition, we may disclose information in response to subpoenas, warrants, or court orders, or in connection with any legal process, or to comply with relevant laws. We may also share information in order to establish or exercise our rights, to defend against a legal claim, to investigate, prevent, or take action regarding possible illegal activities, suspected fraud, safety of person or property, or a violation of our policies, or to comply with our user's requests for the shipment of products to or the provision of services by a third-party intermediary.
- Public: Some of our websites or social media pages may provide the opportunity to post comments, or reviews, in a public forum. If our users decide to submit information on these pages, that information may be publicly available.
How You Can Control Your Information
Some jurisdictions give our users a right to make the following choices regarding their personal information:
- Access To Personal Information: Our users may request access to their personal information or confirmation that we have information about them. In certain limited circumstances, our users may also request to receive access to their data in a portable, machine-readable format.
- Changes To Personal Information: We want to be sure that we keep only the most accurate and up-to-date information about our users in our records. Therefore, whenever our users believe that their contact information needs to be updated, they can email us at info@thephoenix.org to correct or update their contact information.
- Deletion Of Personal Information: Our users may request that we delete their personal information. If required by law, we will grant a request to delete information, but our users should note that in many situations we must keep their personal information to comply with our legal obligations, resolve disputes, enforce our agreements, or for another business purposes.
- Opt-out of Targeted Advertising: Our users may opt-out of online tracking based targeted advertising by adjusting their cookie settings. Please note that if our users change browsers or computers, or clear their browser's cache, they may need to apply their preference again.
- Opt-Out of the Sale of Personal Information: Our users may opt-out of the sale of their information by contacting us at the address described below.
- Objection to Certain Processing: Our users may object to our use or disclosure of their personal information by contacting us at the address described below.
- Online Tracking: We do not currently recognize the “Do Not Track” signal.
- Promotional Mailings: When users register for an account or an event, users agree to receiving marketing and promotional communications from The Phoenix and its affiliates. If a user does not wish to receive marketing communications, users may unsubscribe at any time by emailing at INFO@THEPHOENIX.ORG.
- Promotional Text Messages: If our users receive a text message from us that contains promotional information they can opt-out of receiving future text messages by replying “STOP.” Carriers are not liable for delayed or undelivered messages. Message and data rates may apply.
- Revocation Of Consent: Where we process our user's personal information based upon consent, they may have the right to revoke consent. Please note, if our users revoke their consent for the processing of personal information then we may no longer be able to provide them services.
Please note, not all of the rights described above are absolute, and they do not apply in all circumstances. In some cases, we may limit or deny a request because the law permits or requires us to do so, or if we are unable to adequately verify a user's identity. We will not discriminate against users who exercise their privacy rights under applicable law.
Submitting Requests
Our users may exercise the rights described above by contacting us at INFO@THEPHOENIX.ORG or at the postal address provided in the Contact Information section.
Note that, as required by law, we will require our users to prove their identity. We may verify their identity by phone call or email. Depending on the request, we will ask for information such as name, the last item purchased from us, or the date of the last purchase from us. We may also ask our users to provide a signed declaration confirming their identity.
In some circumstances, our users may designate an authorized agent to submit requests to exercise certain privacy rights on their behalf.
How We Protect Information
No method of transmission over the Internet, or method of electronic storage, is fully secure. Additionally, we maintain internal governance policies designed to protect our user's information. These governance policies may include, but are not limited to, Written Information Security Protocols, Incident Response Plans, Data Subject Request Protocols, and Record Retention and Destruction Policies. While we use reasonable efforts to protect personal information from unauthorized access, use, or disclosure, we cannot guarantee the security of personal information.
Some of our websites permit our users to create an account. When a user creates an account they will be prompted to create a password. Our users are responsible for maintaining the confidentiality of their password, and are responsible for any access to or use of their account by someone else that has obtained the password, whether or not such access or use has been authorized by the user. Our users should notify us of any unauthorized use of their password or account.
How We Retain Information
We retain our user's personal information for only as long as necessary to fulfil the purposes outlined in this Privacy Policy, including for the purposes of satisfying any legal, accounting, or reporting requirements, unless a longer retention period is required or permitted by law. To determine the appropriate retention period for personal information, we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure of the information, the purposes for which we obtained the information and whether we can achieve those purposes through other means, as well as applicable legal requirements.
Transmission of Information to Other Countries
As a multi-national company, we transmit information between and among our affiliates. As a result, our user's information may be processed in a foreign country where privacy laws may be less stringent than the laws in the user's home country. Nonetheless, where possible we take steps to treat personal information using the same privacy principles that apply pursuant to the law of the country in which we first received the user's information. By submitting personal information to us our users agree to the transfer, storage and processing of their information in a country other than their country of residence including, but not necessarily limited to, the United States.
Third Party Applications / Websites
Other Internet sites our users visit – including those linked from the Company website or mobile application – may have their own privacy policies or no policy at all. Other websites might use personal information differently than our policy permits. We are not responsible for and do not control those third parties and the use of their platforms. We strongly encourage our users to review the privacy policies of any site before providing any personal information.
